A Certificated Bailiff will attend at your tenant's premises [WITHOUT NOTICE]. The Bailiff will make an inventory of all the stock and equipment found at the premises. Photographs will be taken of these goods and all will be security marked. The Bailiff will collect your rent arrears from the tenant or give them 5 days Walking Possession to come up with the money. In the event that the arrears go unpaid, these goods will be seized and sold. The proceeds will be used to repay the rent arrears. Be reassured that, faced with a fully trained, authorised and Certificated Bailiff the tenant will normally pay. Only around 3% of tenants have their goods removed. A Certificated Bailiff will attend at the tenant's premises by appointment. As with a standard distraint he will make an inventory, take photographs and security mark all items levied upon. A long term Walking Possession agreement will be entered into and the tenant will be given an extended period to repay the rent arrears. The landlord is protected as the assets are now secured against the arrears. The landlord becomes the preferred creditor, even in front of HMRC. A Forfeiture of a Commercial Lease is obviously the last option for a Commercial Landlord. It ends the business of the tenant and returns the premises to the landlord. A Certificated Bailiff will attend at the premises WITHOUT NOTICE, along with a fully qualified locksmith. Entry will be gained, the locks changed and then secured. The new set of keys will be delivered to the Landlord.
